Who Pays For Car Accidents In Texas?

Attorney Jeff Weinstein fights for the injured

Car accidents happen all the time in Henderson County. Victims are left with serious injuries that can take weeks, months, or even years to recover from. Some people never fully recover and are left with a permanent disability. Car accident attorney Jeff Weinstein of Weinstein Law fights for injury victims to help them recover financial compensation.

But who pays that financial compensation? Usually, it's the insurance company. In Texas, every driver is required to have car insurance with liability coverage for injuries and property damages. The minimum amounts of liability coverage allowed are:

  • $30,000 for each injured person, per accident
  • $60,000 total for all injuries in an accident
  • $25,000 for property damage, per accident

But these are only minimums, and it's a good idea to buy higher amounts of liability to protect yourself. In addition, you can buy optional insurance coverage. For example, personal injury protection (PIP) pays for medical expenses and a percentage of lost income. Collision coverage pays for damage to your vehicle. And uninsured and underinsured motorist (UIM) coverage pays for damages caused by a driver who is either uninsured or underinsured.

If you are hurt in a car wreck caused by another driver, you can file a claim with that driver's insurance company. This is known as a third-party claim. It sounds like it should be a straightforward process, but it's usually pretty complicated. That's because the insurance company would like to pay you as little as they possibly can - preferably nothing.

The insurance company may make you a settlement offer, but it likely won't come close to covering the damages that you suffered. They may question the extent of your injuries and whether certain treatment is needed. They may even say that you were at least 51% to blame for the accident, which would make you unable to recover compensation.

An attorney who knows how to get results

That's why you need an experienced car accident lawyer on your side. Jeff Weinstein knows how insurance companies operate. He investigates your accident to get the facts. Then he builds a strong case that proves another driver was negligent and caused your accident. He fights for every dollar you should be receiving in compensation.

But if the insurance company won't negotiate, your next option is to take the at-fault driver to court. Jeff began his career as a prosecutor and has tried hundreds of cases. He knows how to get results in the courtroom.

In some cases, a driver who has no insurance - or not enough - causes an accident that leaves people hurt. Recovering full compensation in these cases can be difficult.  If you chose to buy uninsured or underinsured motorist protection (UIM) with your insurance policy, you can file a claim with your insurance company.

But if you do not have this coverage, your options are limited. You can file a lawsuit against the driver who caused the accident. But even if you win, recovering compensation can be difficult. That driver may not have enough assets to pay damages.
