Dallas Car Accident Lawyer

An experienced Texas attorney fighting for your recovery after a crash

A car accident in Dallas can happen without warning. One moment you’re driving to work on I-35 or I-45 or running a quick errand on a city street. You are obeying traffic laws and paying attention. Then everything changes. A driver runs a red light and slams into your car. Someone texting drifts into your lane. You’re stopped at a light and get hit from behind at full speed. A speeding driver loses control on the freeway and causes a chain-reaction crash.

The impact is violent. Your car is damaged. Your body is jolted. There is glass, noise, pain, and fear. If help arrives quickly, you are taken to the hospital where doctors order tests and confirm your injuries. Your daily life is suddenly disrupted.

While you focus on recovery, medical appointments, and missed work, the insurance company is already busy. They’re investigating the crash and building a case to pay as little as possible. They’re not on your side and they hope you face this process alone.

Weinstein Law has been fighting for car accident victims in Dallas for nearly 40 years. We know how insurance companies operate. We know how to prove negligence, what your case is actually worth, and how to make sure you recover compensation. What makes Dallas particularly dangerous for car accidents?

Dallas is a big city with lots of traffic, and lots of traffic comes with lots of collisions. Every day, car accidents happen on Dallas roads: I-35, I-45, I-30, the Dallas North Tollway, the President George Bush Turnpike, and Loop 12. These highways see thousands of vehicles daily. Local streets see constant traffic. Intersections are potential accident zones. Parking lots are accidents waiting to happen.

When cars collide at highway speeds, the results are serious. People get hurt. Some get hurt badly. Some don’t survive.

Attorney Jeff Weinstein knows the streets of Dallas and where problem areas exist. He has seen how these crashes happen, how severe the injuries can be, and how quickly a routine drive can turn into a life-altering event. That local knowledge matters when it comes to understanding what went wrong and holding the right parties accountable.

What types of car accidents do we handle?

Car accidents take many forms, and we handle them all, including:

Rear-end collisions

You’re stopped at a light or in traffic, and someone behind you isn’t paying attention and crashes into your car. These accidents cause whiplash, back injuries, and neck injuries. They seem minor but often cause lasting pain and problems. Insurance companies downplay rear-end injuries, which is why expert representation matters.

Intersection collisions

Someone runs a red light or fails to yield, and crashes into your vehicle. These can be catastrophic. T-bone accidents (side impact) are especially dangerous because the side of a car offers less protection than the front or back. These collisions cause serious injuries.

Sideswipe accidents

A driver changes lanes without checking their blind spot, or drifts into your lane, and scrapes along the side of your car. These can cause loss of control, especially if you’re on a freeway. You might swerve to avoid further impact, which can lead to a rollover or collision with another vehicle.

Head-on collisions

Two vehicles traveling toward each other collide front-to-front. These are the most violent accidents and often result in serious injury or death. The forces involved are extreme, two vehicles traveling at a combined high speed meeting in an instant.

Multi-vehicle pileups

One accident triggers others. A driver stops suddenly, the car behind them doesn’t stop in time, and suddenly three or four or five cars are involved. These accidents are chaotic and the injuries can be varied and severe.

Rollover accidents

Your car flips. This can happen if you swerve to avoid something, if you’re hit at the right angle, or if your vehicle isn’t stable (some SUVs are prone to rollovers). Rollovers are extremely dangerous. You’re rolling in a metal box. The roof crushes. Windows break. You’re thrown around the interior of the vehicle.

Hit and runs

Someone hits your car and drives away. Later, police find them, or maybe they don’t. Either way, your uninsured/underinsured motorist coverage (if you have it) becomes important. We help you pursue claims against your own insurance when the at-fault party can’t be found or doesn’t have adequate insurance.

What are common injuries from Dallas car accidents?

When cars collide, human bodies experience extreme forces. The damage can be serious, and it can lead to injuries such as:

  • Whiplash: Your head and neck are thrown forward and then back (or vice versa) suddenly. The soft tissues in your neck, muscles, ligaments, tendons, are stretched and torn.
  • Back injuries: The impact forces compress your spine or cause discs to herniate. Back pain can be acute or chronic. Herniated discs sometimes require surgery. Chronic back pain affects your ability to work and enjoy life.
  • Head injuries and concussions: Your head strikes something in the vehicle interior or you experience the violent acceleration-deceleration forces that cause the brain to move within the skull.
  • Fractures: Bones break. Arms, legs, ribs, collarbones, facial bones. Some fractures are simple and heal well. Others are compound fractures where bone pierces skin, or comminuted fractures where bone shatters into multiple pieces.
  • Internal injuries: The impact forces organs against internal structures. Liver damage, kidney damage, bleeding in the abdomen or chest.
  • Lacerations and bruising: Glass, metal, and the impact itself cause cuts and bruises. Most heal, but severe lacerations leave scars. Bruising that appears minor might represent deeper tissue damage.
  • Psychological injuries: The trauma of a car accident causes PTSD, anxiety, and depression. You’re afraid to drive. You have panic attacks in cars. Some accident victims never fully recover psychologically and avoid driving forever.

How is negligence proven in a Dallas car accident?

In Texas, to recover compensation from the at-fault driver, you must prove negligence. Negligence has four elements:

  • Duty of care: The other driver owed you a duty to drive safely and follow traffic laws. Every driver has this duty to every other person on the road.
  • Breach of duty: The other driver violated that duty. They ran a red light, were texting while driving, speeding, driving drunk, driving recklessly, or they failed to check their blind spot. They may have been drunk, driving recklessly.
  • Causation: The breach caused your car accident. If they hadn’t run the red light, the collision wouldn’t have happened. If they hadn’t been texting, they would have seen you and stopped. The breach is the reason the crash occurred.
  • Damages: You suffered actual injury and loss. You have medical bills, lost wages, pain and suffering. The crash caused real, measurable harm.

Usually, negligence is straightforward. A driver who runs a red light clearly violated traffic law and caused the accident. A driver who was texting clearly breached their duty of care. The evidence supports negligence.

But sometimes, liability is disputed. The other driver claims the light was green. There are no witnesses. It becomes a “he said, she said” situation. This is where investigation matters. Police reports, traffic light timing data, surveillance cameras, and witness statements establish what actually happened.

How does comparative fault work in Texas?

Texas uses modified comparative fault. If both drivers contributed to the accident, recovery is still possible, but may be reduced. For example, if you were partially at fault (maybe 20% at fault) and the other driver was mostly at fault (80% at fault), you can recover, and you get 80% of your damages.

However, if you are found to be more than 50% at fault, you can’t recover anything. Insurance companies use comparative fault as a defense. They’ll try to blame you for the crash, claim you were speeding, or distracted, or failed to see the other vehicle. They try to inflate your percentage of fault to reduce what they have to pay.

That’s why detailed investigation matters. We gather evidence that establishes your actions and the other driver’s actions. We show who was at fault and why. When it comes time to negotiate, we counter the insurance company’s attempt to shift blame to you.

What is my Dallas car accident case worth?

Your car accident case value depends on several factors, including the severity of your injuries, higher medical costs, income loss, insurance policy limits, and an insurance company’s willingness to settle.

Given these factors, here’s what typical car accident cases settle for:

  • Minor injury, quick recovery: $10,000 - $25,000
  • Moderate injury with some treatment: $50,000 - $150,000
  • Serious injury requiring surgery or extended treatment: $150,000 - $500,000
  • Permanent injury affecting work or quality of life: $250,000 - $1,000,000+

These are ranges, and every case is different. But understanding these ranges helps you know if an insurance company’s offer is fair or insulting. Attorney Jeff Weinstein will look at every possible avenue to determine how much money you’re owed.

What happened after my car accident in Dallas?

The first 24 hours after an accident are critical. What you do (or don’t do) can significantly affect your case. Here are the steps you should take:

  • Seek medical attention: If you’re injured, see a doctor immediately. Medical documentation is evidence. It shows you were injured and how seriously. Even if you think injuries are minor, get checked out. Some injuries worsen over hours or days.
  • Document the scene: If it’s safe, take photographs of your vehicle, the other vehicle, the crash scene, road conditions, and traffic signals.
  • Get information: Get the other driver’s name, phone number, address, insurance information, license plate number. Get witness information if anyone saw the crash, as well as the police report number.
  • Report the accident: File a police report if it’s an injury accident or significant property damage. Police reports document the accident and sometimes cite the at-fault driver.
  • Notify your own insurance company: You’re required to. Don’t admit fault, but do report the crash. Your insurance can help with your medical bills even if the other driver is at fault.
  • Preserve evidence: Don’t immediately repair your vehicle. Insurance might want to inspect it. Don’t throw away damaged clothing. Don’t discard medical items. Evidence preservation is important.
  • Avoid social media: Don’t post about the crash on social media or anywhere online. Insurance companies monitor your accounts. Posts showing you active or happy can be used against your pain and suffering claim.
  • Don’t give recorded statements to insurance: The other driver’s insurance adjuster might call asking for a recorded statement. Don’t give one without an attorney present. Anything you say can be used against you.

Why hire a Dallas car accident lawyer?

You might wonder whether you really need a lawyer after a Dallas car accident or if you can handle the insurance company on your own. While some people try, the process is rarely fair or balanced. Insurance companies are built to protect their bottom line, not to protect you, and having a lawyer changes that dynamic immediately. Here’s why you need a Dallas car accident lawyer on your side:

  • Insurance companies lowball unrepresented people. They assume you don’t know what your case is worth and hope you will accept a quick, undervalued settlement offer.
  • It’s difficult to value a case without experience. You may not know whether an offer reflects your true medical costs, lost income, and future impact.
  • Insurance companies use tactics to weaken claims. Recorded statements, blame shifting, and arguments about pre-existing conditions are common.
  • You need time to heal. Investigating the crash, gathering evidence, and negotiating takes time and energy you likely do not have.
  • Lawyer involvement changes leverage. Insurance companies take claims seriously when they know trial is an option.
  • Legal knowledge and resources matter. Jeff Weinstein understands Texas law and can use experts to build strong cases.
  • No upfront cost. Contingency fees mean you pay nothing unless money is recovered.
  • Direct access and guidance. You work directly with an experienced attorney who stays involved from start to finish.
